FAQs

Q. When stopped by police, should I exit my vehicle?
A. No, you should never exit your vehicle unless instructed to do so by the police officer.

Q. Why does a police vehicle follow behind you for such a great distance before pulling you over?
A. For safety, police officers are trained to conduct traffic stops in well-illuminated areas and also areas where it is safe to exit a vehicle. Therefore, the final stop location might be some distance from the actual area where the officer observed the traffic violation.

Q. When a police officer using radar stops me for speeding, do I have the right to see the speed displayed on the radar unit?
A. No, Georgia law only requires an officer using radar to ask the violator if he/she would like the radar tested for accuracy by the officer before the citation is issued.

Q. When issued a traffic citation, am I required to sign the citation or can I refuse?
A. By signing a traffic citation you are not admitting guilt, you are only acknowledging your awareness of the assigned court date. Therefore, yes you are required to sign the citation but you can also refuse. Should you refuse to sign the citation, you are still responsible to appear in court to answer the charges.

Q. When involved in a minor auto accident, is it necessary to have the police respond to take a report?
A. You should always have a police report taken when involved in an auto accident. However, should you choose not to have a police report taken, understand that insurance companies usually require a police accident report if you file a claim.

Q. When involved in an auto accident where there are moderate or extensive damages, should the vehicles be moved to the side of the road prior to police arrival?
A. Yes, Georgia law requires vehicles that are movable to be moved to the side of the road to avoid traffic tie-ups. This can be done prior to police arrival.

Q. I live in a fairly safe neighborhood, is it really necessary to invest in a home security system?
A. Yes, invest in a home security system that’s monitored. Burglaries can happen in any neighborhood; therefore, you should not wait until it happens to your neighbor’s home before taking security precautions.

Q. How and where can I file a complaint against a police officer?
A. If your complaint is concerning your innocence or guilt of an alleged offense; your complaint should be filed during your court hearing. If your complaint is concerning the conduct of a police officer, you should file a citizen complaint form available at the police department.  Each complaint is investigated.
